Definitions
- Artiste refers to Dave Royal.
- Promoter refers to the client or contracting party engaging the Artiste.
- Performance refers to the entertainment services to be provided by the Artiste.
- Booking Agreement refers to the written or emailed confirmation outlining the agreed performance details and fees.

Booking and Confirmation

A booking is only deemed confirmed when:
- the Promoter has returned the Booking Agreement and these Terms and Conditions by email;
- the Artiste has received the agreed deposit or full fee.
- The Promoter must pay the required deposit within 7 days of the Booking Agreement being issued. Failure to do so may result in the date being released.
- All deposits and part‑payments are non‑refundable, unless expressly stated otherwise.
- The remaining balance must be paid no later than 7 days prior to the Performance date. Non‑payment by this deadline constitutes cancellation by the Promoter (see Clause 6).

A booking is only deemed confirmed when:

Artiste Obligations
- The Artiste will arrive at the venue in sufficient time to prepare for the Performance.
- In the event that the Artiste must cancel the Performance for reasons not attributable to the Promoter, including government restrictions, all monies paid by the Promoter will be refunded in full. This shall be the Promoter’s sole remedy.

Promoter Obligations
- The Promoter shall ensure that suitable facilities, access, and conditions are provided to enable the Artiste to prepare and perform safely and effectively.
- The Promoter agrees to indemnify the Artiste against any loss or damage to equipment or property belonging to, loaned to, or being purchased by the Artiste, where such damage is caused by attendees or third parties present at the event.

Contract Formation
- An email sent to info@daveroyalmagician.co.uk containing the completed Booking Agreement and acceptance of these Terms and Conditions, together with payment of the agreed deposit or fee, constitutes a binding contract.

Cancellations by the Promoter
- If the Promoter cancels a confirmed booking, the following cancellation charges apply:
- All deposits are forfeited in addition to the above cancellation charges.
- All cancellations must be made in writing by email. Cancellation fees must be paid in accordance with the payment terms set out in the Booking Agreement.
Time Before Performance
Over 6 months
Cancellation Fee: 25% of agreed fee
Time Before Performance
3–6 months
Cancellation Fee: 50% of agreed fee
Time Before Performance
Under 3 months
Cancellation Fee: 100% of agreed fee

Non‑Payment
- Failure to pay the outstanding balance by the due date shall be treated as a cancellation by the Promoter and will incur the cancellation charges outlined in Clause 6.

General
- These Terms and Conditions form part of the contractual agreement between the Artiste and the Promoter and shall prevail over any conflicting terms issued by the Promoter.
- These Terms and Conditions are governed by the laws of England and Wales, and the parties submit to the exclusive jurisdiction of the English courts.
